1. Application for Returns/Refunds
- 1.1. Subject to the Seller Refunds and Return Policy, Buyer may apply via Kiwanis Muar for return of the purchased item(s) or refund prior to the expiry of Seller’s guarantee period as stated in the Refunds and Return Policy of Seller.
- 1.2. Users will have to communicate with Seller directly to resolve their differences or approach their relevant local authorities to assist them in overcoming any dispute.
2. Return of an Item(s)
- 2.1. Subject to the Seller Refunds and Return Policy, Buyer may apply for the refund or return of the Item(s) in the following circumstances:
- 2.1.1. The Item has not been received by Buyer unless the Seller is able to show proof that the Buyer has received the item;
- 2.1.2. The Item was defective and/or damaged on delivery whereby the Buyer must show proof of the said defect and/or damage within 24 hours of receiving the said item;
- 2.1.3. The Item received is incomplete (missing quantity or accessories) whereby the Buyer must show proof of the said item being incomplete within 24 hours of receiving the said item ;
- 2.1.4. Seller has delivered an Item that does not match the agreed specification (e.g. wrong size, colour, etc.) to Buyer whereby the Buyer must show proof of the said irregularity within 24 hours of receiving the said item;
- 2.1.5. The Item delivered to Buyer is materially different from the description provided by Seller in the listing of the Item whereby the Buyer must show proof of the said irregularity within 24 hours of receiving the said item;
- 2.1.6. The Item received is a counterfeit item, if seller has stated item is original whereby the Buyer must show proof of the said irregularity within 24 hours of receiving the said item;
- 2.1.7. The Item received has physical damage (e.g. dented, scratched, shattered) whereby the Buyer must show proof of the said damage within 24 hours of receiving the said item ;
- 2.1.8. The Item received is faulty (e.g. malfunction, does not work as intended) whereby the Buyer must show proof of the said irregularity within 24 hours of receiving the said item;
- 2.2. Buyer’s application must be submitted via Kiwanis Muar.
- 2.3. The approval of your request for refund or return will be made by seller in its sole discretion. Buyer acknowledges and agrees that seller’s decision is final, conclusive and binding, and covenants and agrees that it will not bring any suit and/or otherwise assert any claim against Kiwanis Muar and/or its affiliates in relation to such decision.
- 2.4. In the event where the Buyer has commenced any legal action against the Seller, the Buyer may provide the formal notification from the appropriate authority to Kiwanis Muar to request Kiwanis Muar to continue to hold the purchase monies until a formal determination is available. Kiwanis Muar will, at its sole and absolute discretion, determine whether it is necessary to continue to hold such purchase monies on behalf of the Buyer.
3. Rights of Sellers
- 3.1. When Buyer submits an application via Kiwanis Muar for the return or refund of the item, Kiwanis Muar will notify Seller in an automated notification. Seller may respond to Buyer’s application according to the steps provided by Kiwanis Muar in the notification. Seller must respond within the time-frame stipulated in the written notification. Should Buyer not hear from Seller within the Stipulated Period, Kiwanis Muar will assume that Seller has no response to Buyer’s application and will proceed to assess Buyer’s application without further notice to Seller. Kiwanis Muar will review each Seller’s response on a case-by-case basis and, in its sole discretion, determine whether Buyer’s application may be successful against the circumstances stated by Seller.
4. Condition of Returning
- 4.1. Buyer should ensure that the Item, including any complimentary items such as accessories that come with the Item, must be returned to Seller in the condition received by Buyer on delivery. Buyer to must take a photo of the Item upon receipt as proof in order to apply for refund herein.
5. Liability of Return Shipping Fee
- 5.1. In the scenario of an unforeseen error from the seller's end (i.e. - damaged, faulty or wrong Item delivered to the buyer) whereby proof has been shown by the Buyer and Kiwanis Muar has determined in its sole discretion that the Buyer’s application for return is successful as stipulated in clause 3, the seller will bear buyer's return shipping fee.
- 5.2. In the scenario where both seller- and buyer dispute the party liable for the return shipping fee, Kiwanis Muar at its sole discretion will determine the party liable for the return shipping fee.
6. Refunds
- 6.1. Buyer will only be refunded after Kiwanis Muar has received the confirmation from Seller that Seller has received the returned Item. In the event where Kiwanis Muar does not hear from Seller within seventy two (72) hours , Kiwanis Muar will be at liberty to refund the applicable sum to Buyer without further notice to Seller and the Seller will be liable to indemnify Kiwanis Muar if the monies has been paid to the Seller. The refund will be made to Buyer’s credit/debit card or designated bank account, whichever is applicable.
7. Communication
- 7.1. Both Buyer and Seller are to communicate with each other in the event where problem arises in a transaction using in-app messaging and notification app to ensure communication of both buyer and seller can be monitored by Kiwanis Muar
